On
September 30, 2004, the international prescription
drug company Merck announced the worldwide withdrawal
of the arthritis medication Rofecoxib, sold
in most countries under the brand name Vioxx,
because a study showed an increased risk of
heart attack and stroke. Patients who have suffered
injuries due to Vioxx have filed litigation
against Merck for failing to recall the drug
when it first learned of Vioxx's dangerous side
effects.

| The
study that led to the recall of Vioxx showed that
patients regularly taking Vioxx faced twice the
risk of a heart attack compared to patients not
taking Vioxx. Vioxx users with a history of cardiovascular
issues were at a five-fold increased risk. |

Lawsuit and Vioxx Class Action |
| Families
of Vioxx patients, including clients of Lieff Cabraser,
who have died and patients who have suffered severe injuries
from heart attacks or strokes after having ingested Vioxx
for an extended period have filed lawsuits against Merck.
|
| The
Vioxx lawsuits allege that Merck falsely promoted the
safety of Vioxx and failed to disclose the full range
of the drug's dangerous side effects. |
| On
October 6, 2004, the Wall Street Journal reported
that the drug Vioxx may have led to more than 27,000 heart
attacks and sudden cardiac deaths before it was pulled
from the market, citing an unreleased study by government
regulators. The estimate of deaths were based on findings
from an analysis of a database of patients of Kaiser Permanente,
one of largest health-maintenance organizations in the
U.S. |
| On
November 4, 2004, the British medical journal The Lancet
published a study that concluded Merck and federal officials
should have withdrawn the painkiller Vioxx from the market
as early as 2000 because studies of the drug had clearly
shown that it doubled the risk of heart attacks among
users. |
| Legal
Background: The Rights of Patients Injured by Prescription
Drugs |
| The
law in most states provides several personal injury claims
for persons who have been seriously injured by a prescription
drug with dangerous, undisclosed side effects. These claims
include strict liability for a defective product, breach
of warranty, negligence, and misrepresentation. Persons
living outside the U.S. who have been injured by a product
manufactured in the U.S. may also in certain cases file
lawsuits for compensation for injuries in U.S. courts. |
| Damages
sought against manufacturers of an allegedly dangerous
prescription drug typically include: |
- Physical
pain and suffering, mental anguish and physical impairment;
- Medical
expenses associated with the allegedly defective product;
and
- Loss
of earnings and/or earning capacity.
|
| For
persons who have died, family members can bring a wrongful
death action. |

| Persons
seeking to preserve any potential legal claims for allegedly
dangerous and/or defective products should contact an
attorney promptly because all states have mandatory time
periods (called "statutes of limitation") within
which lawsuits must be filed. Otherwise, a person's claims
may be forever barred. In some states, the statute of
limitations period for filing personal injury claims is
only one year from the date of injury. |

"Merck's
Vioxx Liability Could Reach $38 Billion,"
Forbes, Dec. 3, 2004
The legal liability to Merck for the withdrawn
arthritis drug Vioxx could be huge, according
to Richard Evans, an analyst at Sanford C. Bernstein.
If all the patients who had heart attacks as a
result of taking Vioxx were to receive an average-sized
legal settlement, Evans wrote in a research report,
Merck's liability could reach $38 billion.
